1. Overview

Purpose of this page

Vestora Technologies LLC (“Vestora”) operates an analytics-first real estate platform that displays listing content from the MIAMI Association of REALTORS multiple listing service (the “MIAMI MLS”) under the supervision of a sponsoring broker, Kingsley Real Estate Corp. This page identifies the designated agents for receiving notifications of claimed copyright infringement under the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. §512, and describes the procedures Vestora and Kingsley follow when such notifications are received.

The designated agents named below are registered in the U.S. Copyright Office’s DMCA Designated Agent Directory under the registration numbers indicated. The directory is publicly searchable. The contact information published on this page matches the contact information published in the federal directory.

Two registrations, one inbox

Vestora Technologies LLC (the “Technology Provider”) and Kingsley Real Estate Corp (the “Sponsoring Broker”) are each independently registered with the U.S. Copyright Office. Both designated-agent registrations route public takedown notices to the same monitored mailbox, dmca@vestoraiq.com, which Vestora maintains under its obligations as Technology Provider. Both registrations remain legally distinct service providers, and the brokerage and Vestora each retain their own DMCA safe-harbor status.

3. Notification of claimed infringement (takedown procedure)

To submit a notification under 17 U.S.C. §512(c)(3), please send a written communication to the designated agent at dmca@vestoraiq.com. To be effective under the DMCA, your notification must include substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Vestora to locate the material, including the URL(s) at which the material appears on the Vestora platform.
  4. Information reasonably sufficient to permit Vestora to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Materially false notifications

Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages. Please do not submit a notification unless you are certain that you own (or are authorized to act on behalf of the owner of) an exclusive right that has been infringed.

How Vestora responds

Upon receipt of a notification that substantially complies with the requirements of §512(c)(3), Vestora will (a) expeditiously remove or disable access to the material that is the subject of the notification, (b) take reasonable steps to notify the subscriber who posted or controlled the material, when applicable, that the material has been removed or disabled, and (c) forward a complete copy of the notification to the multiple listing service from which the identified content originated. For MIAMI MLS content, the copy is forwarded to the MIAMI Association of REALTORS at legal@miamire.com and dmca@miamire.com within twenty-four (24) hours of receipt, as required by the MIAMI MLS IDX & VOW License Agreement. Content licensed from any other multiple listing service is forwarded to that service as its own licence agreement requires.

4. Counter-notification procedure

If you believe that material you posted (or that originated from your authorized content) has been removed or disabled by mistake or misidentification, you may submit a counter-notification under 17 U.S.C. §512(g) by sending a written communication to dmca@vestoraiq.com. To be effective under the DMCA, your counter-notification must include substantially the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address is located (or, if your address is outside of the United States, for any judicial district in which Vestora may be found), and that you will accept service of process from the person who provided the notification under §512(c)(1)(C) or an agent of such person.

Restoration of material

Upon receipt of a counter-notification that substantially complies with §512(g), Vestora will promptly provide the complaining party with a copy of the counter-notification and inform that party that Vestora will replace the removed material or cease disabling access to it in not less than 10, nor more than 14, business days following receipt of the counter-notification, unless Vestora first receives notice from the person who submitted the original notification that such person has filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on Vestora’s platform.

5. Repeat-infringer policy

Consistent with 17 U.S.C. §512(i), Vestora has adopted and implemented a policy that provides for the termination, in appropriate circumstances, of subscribers, account holders, or other users of the Vestora platform who are repeat infringers of copyrights.

Vestora maintains internal records of takedown notifications it receives and the accounts associated with the allegedly infringing activity. An account that is the subject of repeated, valid takedown notifications may be suspended or terminated in Vestora’s sole discretion. Where the account is associated with a sponsoring brokerage or licensed real estate professional, Vestora will additionally notify the affected brokerage and, where applicable, the MIAMI Association of REALTORS.

6. Where this policy applies

This policy applies to all surfaces operated under Vestora’s control that display, deliver, or transmit listing content, including:

  • The Vestora marketing website at vestoraiq.com and any subdomains thereof.
  • The Vestora iOS application distributed via the Apple App Store.
  • Any communications, exports, or transient surfaces that include MIAMI MLS Licensed Content provided to Vestora under the MIAMI MLS IDX & VOW License Agreement.

For the avoidance of doubt, the term “Website” in the MIAMI MLS IDX & VOW License Agreement is defined to include mobile applications (§II.L), and accordingly this policy applies identically to the Vestora iOS application and the Vestora website.
